Juana Rivas sentenced to pay almost two thousand euros of expenses to the father of her children

The controversial case of Juana Rivas returns to the forefront with a new sentence, which forces her to pay 1,912 euros to her ex-partner for expenses incurred in moving her to Spain to pick up her children.

Franceso Arcuri initially claimed 5,589 euros for the costs of the trip from the town of Carloforte, in Italy, to Granada. That is, the 36 hotel nights plus living expenses, in addition to the return trip and diets of both him and his two children. All expenses for the month you stayed in Spain, while Juana Rivas remained unaccounted for with her children last summer. In addition to the return trip, already with the children.

During the hearing held on February 7, that amount was reduced only to documented expenses: almost 2,000 that now Juana Rivas must pay, although his former partner reserves the right to "claim other amounts." In particular, it can be increased as you can document the expenses made by card with invoices, which could reach 7,000 euros.

Juana Rivas, on the other hand, has described the sentence as "very unfair", announcing that she will also appeal the ruling and that she trusts that "in the end everything will add up" and justice will end up giving her reason. "It takes patience."

In fact both have the right to appeal. The Court of First Instance 3 of Granada, states that its decision is not firm, so that it is possible to appeal against both parties to the Court of Granada.

This new chapter of the case of Juana Rivas, occurs after several months of struggle in the courts and Juana's refusal to give her children last summer, which caused Arcuri to have to come to Spain personally to pick them up.

Rivas always explained that he had to flee from Carloforte with his children, aged 11 and 3, due to the alleged ill-treatment of his then partner and father of the children, whom he reported in 2016 in Spain.

The Court of Violence on Women 2 of Granada rejected the proceedings for alleged ill-treatment when they understood that the events took place in Italy and that therefore the competent jurisdiction is Italian, where the complaint was sent.

After exhausting all the resources to support the minors in Spain, Juana Rivas was forced to return her children to the father, to which she refused and remained for almost a month unaccounted for, in breach of court decisions. Thus she was accused of the alleged crimes of child abduction and disobedience. Finally, Juana Rivas gave the children, who moved to Italy with their father.

"It is impossible to know if, today, he would act the same again," Juana Rivas replied when asked if she regrets having retained her children, and added "I was a victim who escaped" because I was the only one alternative to the situation of "violence" I was living.
