Return of personal income tax for maternity and paternity: seven answers to your questions before requesting

A few days ago we told you that the form for the return of personal income tax is almost ready. We have contacted the AEAT and they tell us that "it is imminent" and that "shortly" the way to request it will be announced.

Everything indicates that in the next few days it can be done. But before doing so, we give you seven answers to the most frequently asked questions about the return of personal income tax you have paid for your maternity and paternity benefit.

1) When and how can I claim?

Since last October 5, when the Supreme Court ruled that maternity benefits are exempt from personal income tax it was learned that I was going to pay back in the corresponding declarations.

The return mechanism is being prepared. The data of potential beneficiaries have already been crossed, legal and technical issues are being resolved, and "soon" You can claim, as we have confirmed direct sources of the AEAT. It is believed that it could be next week.

How? The official form will be posted on the website of the Tax Agency to be able to do it telematically. An information campaign will be launched to publicize the procedure.

2) Can I claim in another way?

A regular claim process can be initiated, but a lot of documentation must be provided and returns that are not made through the official form being prepared are not guaranteed. So experts recommend waiting a few days and do it by the standardized route It will be launched shortly.

3) Who can claim?

All those women who have received the maternity benefit in the years 2014, 2015, 2016 and 2017 and they included it in their personal income tax returns. And yesterday we learned that the Treasury will also return the IRPF to parents who have received the paternity benefit in those years.

The freelancers who have received this benefit, who are registered in the RETA and up to date in the payment of the monthly Social Security fees, can also claim the withholdings.

4) How long can I claim?

Do not run in any hurry. The return of 2014, the furthest statement, does not prescribe until June 30, 2019, so there are still seven months.

5) Will all parents receive the return?

No, not everyone will receive the return. José María Mollinedo, General Secretary of the Technical Union of the Ministry of Finance, Gestha, told us that only 17% of mothers who have received the maternity benefit are entitled to the return of their personal income tax. This is because 83% of working mothers receive salaries below 18,400 euros per year.

In Babies and more, Basque farms will return the IRPF of maternity leave, but Navarra will not

For its part, Navarra has announced that the parents of the regional community will not receive the IRPF refund, since the Supreme Court ruling does not affect their own tax regulations.

6) Will we have to deliver paperwork?

No. Social Security has already crossed data with the Tax Agency to prevent taxpayers from having to provide paperwork to prove that the benefit has been collected, and the amount thereof.

7) How much will I charge?

It is impossible to give an exact calculation because it depends on the salary of the beneficiary. It is estimated that returns will be around one thousand two thousand five hundred euros.

For example, if you have earned 54,000 euros a year and charged 3,000 euros of maternity, the difference in fee would be 1,100 euros. Although other variables such as the type of contract will have to be assessed, if you have to deduct rent or mortgage, minor children (before the birth of your last baby), if you have older dependents, etc. Each case is particular..
